Hide AdKate Hart, prosecuting, said police were unable to caution and charge Kay after his arrest because he was so intoxicated.
Kay, 32, of Livingston, West Lothian, pleaded guilty to two offences during the Sunday incident. He admitted behaving in a threatening and abusive manner by uttering threats of violence on a footpath near Columbia Avenue, Livingston.
He also admitted stealing alcohol and food from a Scotmid store.
Jailing Kay, Sheriff Donald Ferguson told him: “I’d be failing in my duty if I didn’t sentence you to imprisonment.”
